Space Debris Rules Reignite Regulatory Turf War

With more than 18,000 satellites currently circling our planet—both operational and defunct—the likelihood of orbital collisions has risen sharply. This figure has more than doubled over the last six years alone. Most of these spacecraft occupy low-Earth orbit, a crowded zone where crashes could generate debris fields capable of making entire orbital regions unusable. While such impacts remain uncommon, the growing congestion makes them increasingly probable.
The Federal Communications Commission recently approved updated regulations designed to modernize satellite approvals and establish fresh space safety measures. Industry leaders largely back these changes. Under the new framework, satellite operators must exchange real-time tracking information, enabling space traffic controllers to maintain a comprehensive view of orbital positions. Previously, predicting potential collisions proved challenging and sometimes hazardous.
A Dispute Over Authority
Despite broad acceptance of the FCC’s rules themselves, the decision has reignited competition between agencies over who controls space regulation. For decades, the FCC has served as the primary satellite overseer, leveraging its power to manage radio spectrum—the frequencies that transmit wireless data from satellites and aircraft. However, as commercial space ventures have expanded, legislators have pushed to transfer regulatory control to the Department of Commerce.
Proponents contend that Commerce could better supervise the sector while collaborating with businesses to maintain America’s global competitiveness in space. Bipartisan support exists for this transition. In February, Republican Brian Babin and Democrat Zoe Lofgren, the top members of the House Science Committee, wrote to the FCC requesting it either withdraw or modify the proposed regulations. They maintained that existing federal statutes lack explicit congressional permission for the FCC to oversee space safety, traffic management, and related non-communications activities.
The FCC has not publicly addressed the correspondence or responded to CNN’s inquiry. Republican committee staff confirmed on Tuesday that Babin and Lofgren subsequently sent a follow-up message to FCC chair Brendan Carr, asking him to delay the vote and engage in discussions with lawmakers. Nevertheless, the commission proceeded with a unanimous decision on Wednesday morning.
Industry Urgency
This regulatory uncertainty reflects the fast-evolving space landscape. As SpaceX, OneWeb, and Amazon deploy hundreds to thousands of new satellites, questions persist regarding oversight authority. Both Congress and President Donald Trump have indicated preferences for the Department of Commerce to assume the role of space traffic regulator, though progress has stalled partly due to unclear funding levels for the agency to undertake this responsibility. The Commerce Department has not yet provided comment to CNN.
“We’re in a gray area right now,” Tom Stroup, president of the Satellite Industry Association, told CNN. “Not a lot had been done with respect to space sustainability” or preventing in-space collisions.
Stroup emphasized that time is critical. The sector holds enormous ambitions: SpaceX aims to launch a constellation containing up to one million satellites while developing orbital data centers. Regarding the FCC’s new sustainability framework, Stroup noted that “one could argue that should have been done five years ago.” He added, “One thing is clear: We can’t wait another five years.”
SpaceX has maintained close ties with the Space Situational Awareness community and considers traffic management a priority. The FCC regulations could establish industry-wide standards that strengthen best practices. This is not the first time the FCC has intervened to guide the sector toward better space stewardship. In 2022, the commission introduced a requirement mandating that operators remove dead satellites within five years, preventing defunct spacecraft from becoming long-term orbital garbage.
